Terms of Service — Ignitra Reach

Ignitra Reach lets businesses connect a WhatsApp Business Account, manage message templates, and send WhatsApp template messages to their own customers through Meta's official WhatsApp Business Cloud API, with delivery reporting and a prepaid credit wallet for usage. All messaging is delivered through Meta's platform and is subject to Meta's and WhatsApp's policies.

• You must be a business (or authorised to act for one) and legally able to enter into these Terms.
• You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity under your account.
• You are responsible for the actions of any staff users you invite to your account.

You are solely responsible for the messages you send and the recipients you send them to. You agree that you will:

• Obtain valid consent from every recipient before messaging them, as required by the WhatsApp Business Messaging Policy and applicable law (including India's DPDP Act).
• Comply with Meta's and WhatsApp's terms, policies, and messaging limits at all times.
• Honour opt-outs and not contact recipients who have opted out.
• Not send spam, unlawful, deceptive, harassing, or prohibited content, and not use the Service for any illegal purpose.
• Only send message templates that have been approved through the official process.

We may suspend or terminate accounts that violate these responsibilities or that put our platform or its other users at risk.

• Access may involve a one-time setup fee and prepaid message credits, as shown to you before purchase.
• Message credits are purchased in advance (via Razorpay) and are consumed as you send messages, at the rates displayed to you.
• Unless required by law, purchased credits are non-refundable and are used only to send messages through the Service.
• All amounts are in Indian Rupees (INR). You are responsible for any applicable taxes.
• We may change fees or rates on a prospective basis, with notice.

The Service depends on Meta's WhatsApp Business Platform. Your use is also governed by Meta's and WhatsApp's applicable terms and policies. We are not responsible for Meta's decisions, including changes to their platform, message pricing, quality ratings, or any suspension or restriction Meta applies to your number or account. "WhatsApp" and "Meta" are trademarks of their respective owners; we are not affiliated with or endorsed by them beyond being a platform user of their API.

The Service, including its software, design, and content (excluding your data and message content), is owned by Ignitra Labs and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You retain ownership of your own content and data.

Our handling of personal data is described in our Privacy Policy. For the recipient data you upload and message, you are the controller and we act as your processor, on your instructions.

The Service is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by law. We do not guarantee that every message will be delivered, that the Service will be uninterrupted or error-free, or that Meta will not restrict your account. Message delivery depends on Meta, the recipient's network, and factors outside our control.

To the maximum extent permitted by law, Ignitra Labs will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, revenues, or data. Our total liability for any claim relating to the Service is limited to the amount you paid to us for the Service in the three (3) months before the event giving rise to the claim.

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by Meta or by law, or to protect the Service or its users. On termination, your right to use the Service ends; provisions that by their nature should survive (including fees owed, disclaimers, and limitation of liability) will survive.

These Terms are governed by the laws of India. The courts at Bhavnagar, Gujarat, India, will have jurisdiction over any dispute, subject to applicable law.

We may update these Terms from time to time. The "Last updated" date reflects the latest revision. Material changes will be communicated to account owners by email or in-app notice; continued use after changes take effect constitutes acceptance.
